This page reflects the legal agreement between you, a site member, and Darkwood Photography LLC. Please read the agreement carefully. By signing up to this site as a member, you agree to be bound to the terms and conditions of this agreement for as long as you use the site in any way.

If you do not agree to these terms, your account will be disabled and all access to content forfeit. Avoid use of this site or any of its contents if you do not agree with the terms herein.

1: Termination – Either you (a member) or Darkwood Models may terminate your site membership and access to any content at any time, for any reason, and without explanation. Darkwood Models may suspend or terminate your access to the site at any time, without notice, upon any breach of this Agreement. You acknowledge that Darkwood Models may periodically remove inactive accounts without notice.

2: Takedown Requests – In compliance with updated credit card processing requirements, models may submit written requests to [email protected] to request to have their content taken down from the site for any reason. Requests to remove content will be honored within 1 business week. Customers impacted by such requests will receive credit on the site. Models who issue these requests must include:

*Their name

*The names of the sets they appear in that they wish to have taken down

*Proof the requestor is the one present in the content or has legal ownership of the content

*The following statement: “I formally request that the content indicated above to be removed from Darkwoodmodels.com and its subsidiaries completely. I understand that this request forfeits any potential future compensation related to my contract(s) with Darkwoodmodels or its representatives.”

If any of this information is not included, the request may not be fulfilled in a timely manner.

3: Hosting Services – In compliance with processing requirements, all models depicted on this site have signed waivers and contracts indicating they understand where/how their content is being displayed and the ownership of that content. All content provided by 3rd parties (other photographers) must include copies of contracts as well as the ID of anyone depicted in that content. Third-party contracts must include clear indicators that the content will be hosted on Darkwoodmodels.com as well as provide the contracted models with information on how to contact the admins of the site and review their content.

4: Personal Use – Your membership to this site is for your sole, personal use. You acknowledge that Darkwood Models may use modern technologies to determine whether or not suspicious behavior (including account sharing) is taking place. You affirm that your account will not be transferred or shared under any circumstances.

5: Lawful Use – You will use Darkwoodmodels.com in a manner consistent with any and all applicable laws and regulations.

6: Content Restrictions – You will not download, screenshot, distribute, or reproduce any content from Darkwoodmodels.com without prior written consent of Darkwoodmodels or the owner of the content in question.

7: Content Licenses – You understand that purchasing content on Darkwoodmodels.com constitutes a license to view content on the site. That license may be altered or revoked at any time, and for any reason. Unless specifically stated, this license prohibits the downloading (including through electronic screenshots) or alteration of any content herein.

8: Non-Solicitation –  None of the services or content on this page will include any form of solicitation for sex.

9: Refunds – You understand that Darkwoodmodels has a strict no refund policy. All sales are final at the time of purchase. If content must be taken down due to a model request, customers will receive site credit towards future purchases.

10: Collection of Information – You agree to allow Darkwoodmodels.com to collect your login navigation and browser information specifically for the purposes maintaining and enhancing this site, or for sales information. You understand that cookies may be used on every page of this site for tracking purposes.

11: Personal Privacy – Darkwood Models does not sell or share this information with outside sources, and will use modern security measures to protect any data from users from non-intended use. Our servers are PCI compliant, with SSL certifications and modern encryption to protect customer data.

12: Disputes – You understand that all questions, concerns, or requests must be emailed to [email protected] and that all disputes or concerns must be raised within 30 days of an applicable issue. Disputes will be investigated by an administrator Darkwoodmodels.com. You acknowledge that Darkwoodmodels has the final authority on any outcome of any dispute.

13: Legal Disputes – All legal disputes not resolved by paragraph 10 may be addressed in court. Fulton County, Georgia shall be the sole venue for addressing legal disputes in court.

14: Integrated Agreement – This is the full agreement of the parties. Any modification must be in writing and signed by all parties.
